Communication of the BIPT Council of 16 December 2014 regarding the monitoring of compliance with Articles 122 and 123 of the ECA

The reports annexed provide an overview of the monitoring of compliance with Articles 122 and 123 of the ECA. The purpose of this monitoring was to get a better idea of what is happening in the sector and to make an informed consideration about further steps. For the investigation mainly the answers given by the operators to the inquiry sent to them in April 2014 were used, as well as the documents published by them, i.e. in essence the general terms and conditions and also other contract forms. During the investigation both the transparency from the operators and the way those operators deal with the consent given by their subscribers were found to be wanting. Frequent shortcomings are uncertainty about the data to be processed and the implications of that processing, consent with processing is de facto not asked but assumed, the possibility to withdraw the consent is not always clear and contracts with third parties offer not enough guarantee for a legal processing of the communication data.

Consultation at the request of the Council of 21 January 2015 on the procedure for designating the universal postal service provider

Bpost is charged with the universal postal service until 31 December 2018, in accordance with the Act of 21 March 1991 on the reform of certain economic public companies (Art. 144octies, § 1). The Act provides for an open procedure for the designation of the universal postal service provider as from 1 January 2019. BIPT organises a public consultation, in the form of a questionnaire, aimed at collecting the opinions of all stakeholders on the universal postal service as a whole. Besides, it also aims at collecting any useful information for the realisation of the designation procedure and the achievement of universal service objectives. The main topics covered by the consultation are the following: - societal interest and content of the US; - users' behaviour (in particular in terms of traffic volumes); - conditions (including, but not only, tariff conditions) in which an operator could show his interest to provide the US, etc.
