Decision of the BIPT Council of 28 September 2016 imposing an administrative penalty upon Scarlet Belgium NV for non-compliance with Article 108, § 2, of the Act of 13 June 2005 on electronic communications
Publications › Decision -
03/11/2016
On 1 December 2015, Scarlet changed its tariffs. Some prices were lowered, other prices went up and also a few discounts disappeared. The notice given by Scarlet consisted only in mentioning a “simplification” of the tariffs on the second page of the bills. As a consequence Scarlet subscribers were not duly informed in accordance with the Telecom Act. Therefore BIPT imposes a fine of 15,000 euro on Scarlet. In addition, for those subscribers who were not given notice again in August 2016 either by way of the bill, Scarlet is ordered to make a new announcement in a form other than the bill and to grant them at the same time in accordance with the Telecom Act a new right to cancel the contract free of charge.
