This opinion is given in the context of a request from the Chamber of Representatives regarding a bill amending the Code of Economic Law in order to combat unwanted cold calling more effectively, pursuant to Article 14, paragraph 1, 1°, of the Act of 17 January 2003 on the status of the regulator of the Belgian postal and telecommunications sectors.

Based on the present test, the BIPT has not identified margin squeeze practices at portfolio level, either on the basis of the SMP operators' own costs nor following certain adjustments to the scale and efficiency of the SMP operators.

In this Decision, the Council of the BIPT imposes an injunction upon Hermes Telecom on pain of a penalty of 3% of the daily turnover on the market concerned to reply within two weeks to one remaining part of a request for information issued in the context of the verification of Easy Switch in 2024.
