Judgement of 7 February 2018 on the appeal against the BIPT Council Decision of 30 May 2016 imposing an administrative fine on Skype Communications for non-compliance with Article 9(1) of the Act of 13 June 2005

Before taking its decision, the Market Court decided to make a reference to the European Court of Justice regarding the definition of the electronic communications service, as laid down in the Directive of 7 March 2002 on a common regulatory framework for electronic communications networks and services.
