This decision defines a national leased lines market based on SDH, WDM and Ethernet technologies, regardless of the speed. It concludes that Belgacom (now: Proximus) has significant power in this market and, as a consequence, imposes a series of remedies on the operator.

Belgacom brought an action for annulment against this decision. This appeal was dismissed by the Brussels Court of Appeal, with the exception of a specific section regarding the access to manholes.
