When the Council observes a violation either of the law or the regulations of which the Institute monitors the observance or a decision taken in application of these, it serves a motivated notice on the offender, while requesting him to correct the violations before a deadline, set by the Council.

If the offender has not corrected his violations on the set deadline, the Council may impose an administrative fine for the benefit of the Treasury of a maximum amount of 5,000 EUR for natural persons or of a minimum of 0.5% and a maximum of 5% of the turnover of the most recent full reference year in the market concerned for legal persons, while the total amount of the fine imposed on a legal person may not exceed 12.5 million EUR.
Alongside the decision mentioned in the previous paragraph, a new deadline is imposed on the offender for correcting the violations.

When the violations are serious and repeated and the measures taken previously were not able to correct them, the Council may, after hearing the offender once again, order the suspension of all or part of the operation of the network or of the provision of the telecommunications or postal service concerned or of the sale or the use of any service or product concerned.
